futures advice business

"futures advice business", in relation to a person, means- [Subs. Act A987] (a) a business of advising other persons about trading in futures contracts; or (b) a business in the course of which the person publishes futures reports; but does not include- (aa) any such act by an advocate, or an accountant in public practice, which is incidental to the practice of his profession; (bb) an act of giving, or holding out as giving, of advice about futures contracts, publishing or holding out as publishing of futures reports, by a person in a newspaper or periodical of which the person is the proprietor or publisher and the newspaper or periodical is generally available to the public otherwise than only on subscription where the sole or principal purpose of the newspaper or periodical is other than to advise persons on futures contracts or to publish futures reports; (cc) an act in the course of or by means of transmissions through an information service that the person owns, operates or makes available, which transmissions are generally available to the public where the sole or principal purpose of the transmissions is other than to advise persons on futures contracts or to publish futures reports; or (dd) any such act of a person (i) while employed by, or acting for or by arrangement with, another person; and (ii) as employee or agent of, or otherwise on behalf of, on account of, or for the benefit of, the other person; and (iii) in connection with a futures advice business carried on by the other person;

futures advice business

"futures advice business", in relation to a person, means- [Subs.
